Client Waiver & Consent

1.What This Service Is

Sunkiss Studios provides custom sunless (DHA-based) spray tanning, applied by airbrush to the outside of your skin, along with optional add-ons such as contouring and red light therapy. These are cosmetic services, not medical or dermatological treatments, and are not a substitute for medical advice.

The active tanning ingredient is DHA (dihydroxyacetone), an ingredient the U.S. FDA has approved for external cosmetic use on skin. DHA is only approved for external application — not for use near the eyes, lips, or mucous membranes, and not for inhalation. See Section 5.

2.Please Tell Us Before Your Appointment

To help us tailor the service safely to you, please tell your technician, before application, about any of the following:

• Allergies or sensitivities, including to fragrances, preservatives, or prior spray tan products
• Skin conditions (eczema, psoriasis, dermatitis, open wounds, sunburn, recent laser or chemical treatments, active acne, etc.)
• Pregnancy or breastfeeding — if you are pregnant or nursing, we recommend you consult your physician before receiving a spray tan, as with any cosmetic product applied to the skin
• Medications that may increase skin sensitivity or photosensitivity
• Recent waxing, shaving, chemical peels, retinol/exfoliant use, or other skin treatments (these can affect tan color and evenness, and freshly irritated skin may be more reactive)

You are in the best position to know your own health history. Please be complete and accurate — the information you give us is what we rely on to serve you safely.

3.Understanding the Risks (Please Read Carefully)

Every cosmetic service carries some risk. By booking with us, you acknowledge and accept the following, which are a normal and known part of spray tanning:

• Staining. The solution can temporarily stain light-colored clothing, bedding, upholstery, car seats, and other surfaces. Please wear dark, loose clothing to and from your appointment and protect surfaces you’ll contact (car seats, furniture, sheets) for at least the first few hours after application.
• Skin reactions. Rarely, some clients experience redness, itching, or a mild allergic-type reaction to DHA or other ingredients, even without a known prior allergy. If you notice a reaction, discontinue rinsing/product use as directed and contact a medical provider if symptoms are more than mild or don’t resolve.
• Color result variability. Your tan’s color, depth, and how evenly it develops depend on your individual skin chemistry, skin prep, and how well you follow aftercare instructions — not solely on the product or technique. We cannot guarantee a specific shade or that your result will look identical to a photo, a prior tan, or another client’s result.
• No UV or sun protection. A spray tan provides no protection from the sun or UV exposure. It does not function as sunscreen and does not reduce your risk of sunburn. Please use proper sun protection separately, as you normally would.

4.Eye, Lip & Airway Protection

We provide protective items (such as nose plugs, lip balm/protectant, and/or eyewear or instructions to keep eyes closed) during application to help you avoid getting solution in your eyes, mouth, or airway. By receiving this service, you agree to use the protection provided and to follow your technician’s in-the-moment instructions (e.g., closing your eyes, holding your breath during spray passes) to minimize exposure to your eyes, lips, mucous membranes, and airway.

5.Aftercare Is Your Responsibility

Your results depend heavily on aftercare. We’ll give you specific instructions (typically covering first-rinse timing, moisturizing, clothing, and activities to avoid in the first 8–24 hours). Following that guidance is your responsibility, and results — including color depth, evenness, and how long the tan lasts — will vary based on how closely aftercare instructions are followed.

6.Mobile / In-Home Appointments

If your appointment is at your home or another location you’ve chosen (a “mobile appointment”), by booking you:

• Grant Sunkiss Studios permission to access the agreed premises at the scheduled time to perform the service;
• Agree to provide a reasonably private, clean, and well-ventilated space for the application (a bathroom or similar area with a door and, where possible, an open window or running fan is ideal);
• Understand that you are responsible for protecting your own home’s surfaces and belongings from potential overspray or staining (see Section 3), and we recommend laying down a tarp, old sheet, or towels in the application area; and
• Acknowledge that travel/setup time is part of your appointment window, and results and application quality can be affected by the space provided (lighting, ventilation, room size).

7.Photo/Video Consent — Optional

We love sharing our work! But this is completely optional and separate from receiving your service.

You may decline and still receive your appointment. You may also withdraw this consent at any time by emailing booking@customspraytans.com.

8.Cancellation & No-Show Policy

• Appointments require at least 24 hours’ notice to cancel or reschedule without penalty.
• Cancellations or reschedules with less than 24 hours’ notice, and no-shows, may result in forfeiture of any deposit paid and/or a cancellation fee charged to the card on file.
• Sunkiss Studios reserves the right to waive this policy at its discretion (e.g., documented emergencies).

9.Minors

Clients under 18 years old may only be serviced with the signature of a parent or legal guardian, who confirms they have authority to consent to this service on the minor’s behalf and have reviewed this document with the minor.

10.Your Acknowledgment

By signing below, you confirm that:

1. You have accurately disclosed the health information requested in Section 2, to the best of your knowledge;
2. You understand this is a cosmetic service using externally-applied DHA, with no UV/sun protection benefit;
3. You understand and accept the known risks described in Section 3 (staining, possible skin reaction, and result variability based on your own skin chemistry and aftercare) as an informed, voluntary participant in this cosmetic service;
4. You agree to use the eye/lip/airway protection provided and follow in-session instructions (Section 4);
5. You accept responsibility for aftercare (Section 5) and, if applicable, for premises access, privacy, and ventilation for mobile appointments (Section 6);
6. You have made your own choice regarding photo/video consent (Section 7); and
7. You agree to the cancellation policy in Section 8.

Nothing in this document is intended to, and nothing in this document shall, excuse Sunkiss Studios from liability for its own gross negligence, willful misconduct, or violations of law, to the extent such liability cannot be limited under Virginia law. This is a statement of informed consent, assumption of the disclosed cosmetic risks described above, and the parties’ respective responsibilities — not a general release of Sunkiss Studios from liability for its own negligence.

11.Severability

If any provision of this document is found unenforceable or invalid under applicable law, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will continue in full force and effect.

12.Governing Law & Venue

This document is governed by the laws of the Commonwealth of Virginia, without regard to conflict-of-law principles. Any dispute arising from this document or the services described shall be brought exclusively in the state or federal courts located in Fairfax County, Virginia.
